Public Utilities and Economic Regulation

Our experienced attorneys have represented for many years public utilities and other businesses subject to a wide variety of state and federal economic regulation and control. Our goal is to achieve success for our clients as quickly and economically as possible. We render practical legal advice based on a sound analysis combined with common sense, years of experience, and contacts throughout the different Commissions and Agencies. We work closely with our public utility and business clients and maintain a high level of personal contact and availability.

Among our special fields of public utility and economic regulation experience are:

  • Agencies: frequent appearances before a broad range of state and federal agencies, including the Public Utilities Commission (primarily telecommunications, electric, and water carrier), the Bureau of Insurance, the Bureau of Banks and Banking, the Health Care Finance Commission, the Maine Milk Commission, and the Interstate Commerce Commission/Department of Transportation/Federal Highway Administration; 
  • Disparate Regulatory Matters: handling a wide variety of regulatory matters, from rate cases to complaints to investigations; 
    Authority, Licenses, Permits: obtaining new and transferring existing operating authority, licenses, and permits; 
  • Approvals/Exemptions: obtaining regulatory approval of, and exemptions from the requirement of approval for, a wide variety of transactions; 
  • Proceedings: representing companies, industry groups and trade associations, and individuals in Rulemakings and other generic proceedings; and 
  • Representing Agencies: representing regulatory agencies in complaints against the agency as well as proceedings against regulated companies and their employees. 

With the support of our corporate team we handle a wide variety of transactional and business matters for our public utility and business clients, including operational issues, shareholder disputes, and purchase and sale of businesses and assets.

With the support of our business litigation team we defend our public utility clients against the adverse claims, big and small, that they encounter from regulators, customers, vendors, competitors, employees, and current and former shareholders.

With the support of our real estate and zoning lawyers, we handle all aspects of real estate transactions from the simple lease to the most complex development, construction, environmental and zoning entitlement issues.
